Terms of Use

These Terms of Use ("Terms") govern access to and use of the websites, applications, and services offered by My Loan Pipeline ("we," "us," or "our") (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

1. The Service

My Loan Pipeline provides software for mortgage lending operations, including pipeline tracking, partner and referral workflows, notifications, reporting, and related tools. We may modify, suspend, or discontinue features with reasonable notice where practicable.

2. Accounts and eligibility

You must provide accurate registration information and keep credentials confidential.
You are responsible for activity under your account and for ensuring users you invite comply with these Terms and your organization's policies.
The Service is for business users involved in mortgage lending or related operations. You must be at least 18 years old and able to form a binding contract.

3. Acceptable use

You agree not to:

Violate applicable law, including mortgage, privacy, and fair-lending requirements;
Upload malware, probe systems without authorization, or interfere with the Service;
Access data outside your authorized role or tenant scope;
Use the Service to send spam or misleading communications;
Reverse engineer the Service except where prohibited restrictions are unlawful;
Resell or sublicense the Service except under a written agreement with us.

Your organization is responsible for the accuracy, legality, and retention of loan and borrower-related data it enters, including obtaining necessary consents and privacy safeguards appropriate to its program.

4. License

Subject to these Terms and any applicable order or subscription agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the subscription term.

5. Customer data and privacy

You retain ownership of data you submit. You grant us a license to host, process, and display that data solely to provide and improve the Service, comply with law, and as described in our Privacy Policy. A separate data processing agreement may apply for enterprise customers.

6. Third-party services

The Service may integrate with third-party identity, email, storage, or analytics providers. Your use of those services may be subject to their terms. We are not responsible for third-party services we do not control.

7. Fees

Paid plans, if any, are governed by the pricing and payment terms presented at purchase or in an order form. Fees are non-refundable except where required by law or expressly stated. We may change prices on renewal with advance notice.

8. Intellectual property

We and our licensors own the Service, software, branding, and documentation. Feedback you provide may be used without restriction or compensation. You may not use our trademarks without prior written consent.

9. Confidentiality

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only for purposes related to the Service, except as required by law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT IT WILL ENSURE COMPLIANCE WITH ANY REGULATORY REQUIREMENT. THE SERVICE IS NOT LEGAL, TAX, OR COMPLIANCE ADVICE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnification

You will defend and indemnify us against third-party claims arising from your data, your use of the Service in violation of these Terms or law, or your organization's lending activities, except to the extent caused by our gross negligence or willful misconduct.

13. Suspension and termination

We may suspend or terminate access for material breach, security risk, or non-payment. You may stop using the Service at any time. Upon termination, your license ends and we may delete data according to our retention policies and any enterprise agreement.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which we operate the Service, without regard to conflict-of-law principles, except where mandatory law in your location requires otherwise. Unless your organization's master agreement specifies a different forum, disputes that cannot be resolved informally may be brought in courts of competent jurisdiction where we are established.

15. General

Entire agreement: These Terms, the Privacy Policy, and any order form constitute the entire agreement regarding the Service unless superseded by a signed enterprise agreement.
Assignment: You may not assign these Terms without our consent. We may assign them in connection with a corporate transaction.
Severability: If a provision is unenforceable, the remainder remains in effect.
Changes: We may update these Terms by posting a revised version. Material changes will be indicated by an updated effective date. Continued use after the effective date constitutes acceptance.
